Terms of Service

1) Overview

This website (the “Site”) is operated by Twelveen LLC (“Twelveen,” “we,” “us,” “our”). We provide the Site, information, tools, and services (collectively, the “Services”) to you conditioned on your acceptance of these Terms of Service (the “Terms”) and the policies referenced here (e.g., Privacy Policy, Shipping Policy, Returns Policy).

By visiting the Site or purchasing from us, you agree to be bound by these Terms. If you don’t agree, please don’t use the Services.

We may update these Terms from time to time by posting a new version on this page. Your continued use of the Services after changes are posted means you accept the changes.

Our store runs on Shopify. Shopify provides the e-commerce platform we use to sell to you.

2) Who can use the Services

You must be at least the age of majority in your state or country to use the Services, or you have permission from a parent/guardian to allow a minor dependent to use the Site. You may not use the Services for any unlawful or unauthorized purpose.

3) Custom & personalized orders (POD)

Most of our items are made to order.

        • Proof & approval. We’ll send a digital proof when applicable. We ship within 1–3 business days after you approve the final proof of your artwork adjustments.

        • Revisions. Revisions are unlimited before approval (unless a product page states otherwise). Changes after final approval may require a reprint fee or a new order.

        • Final sale. Because each piece is made for you, custom/personalized products are final sale except for manufacturing defects or damage in transit (see Returns & Refunds).

        • Color/size variation. Minor differences in color, texture, and size may occur due to display settings, inks, materials, and hand-finishing. These normal variations aren’t defects.

4) Your content & intellectual property

You may upload photos or other content (“User Content”) for us to create your piece.

        • Your rights. You represent and warrant that you own or have permission to use all User Content and that it doesn’t infringe anyone’s rights or violate any law.

        • Your license to us. You grant Twelveen a non-exclusive, worldwide, royalty-free license to use, reproduce, and adapt your User Content solely to make, deliver, and support your order.

        • What we won’t produce. We may decline content that is unlawful, infringing, hateful, pornographic, or otherwise objectionable.

        • Portfolio use (optional). With your consent (opt-in at checkout or by email), we may display your finished piece in our portfolio, social media, ads, or on the Site. You can withdraw consent anytime by contacting support.

5) Prices, promotions, and availability

Prices and product descriptions can change without notice. We may correct errors or cancel orders that result from pricing or availability mistakes (we’ll contact you if that happens). Promotions may have separate terms; unless stated, discounts don’t stack.

6) Orders, billing & account information

We may refuse or limit any order (e.g., suspected fraud). You agree to provide current, complete, and accurate purchase and account information, and to promptly update your info (email, address, payment details) so we can complete your transactions and contact you as needed.

7) Shipping & delivery

Shipping options, timelines, and fees are described in our Shipping Policy, which is incorporated into these Terms.

        • Processing time: Orders ship within 1–3 business days after final proof approval (when applicable).

        • International: International orders are shipped DDU (Delivered Duty Unpaid) from the United States. VAT/GST, duties, and import fees are charged by your local customs office and are the recipient’s responsibility. We can’t mark parcels as “gift” or reduce declared values on customs forms.

        • Forwarders (e.g., MyUS). If you ship to a freight forwarder, our responsibility ends upon delivery to the forwarder’s U.S. address. Damage, loss, or customs issues after that point must be handled with the forwarder.

        • Risk of loss. Risk of loss passes to you when the carrier accepts the shipment. Please track and receive your parcel promptly.

8) Returns, replacements & claims

Our Returns Policy is incorporated into these Terms. Key points for customs/POD:

        • Custom/personalized items: Final sale, except for defects or damage in transit.

        • Issue on arrival? Inspect your parcel on delivery. For damage/defect claims, contact us within 7 days with your order number and clear photos of the item and packaging.

        • Resolution. For eligible issues, we’ll repair, replace, or refund at our discretion. We may ask you to return or safely dispose of damaged items.

9) Optional tools & third-party links

We may provide access to third-party tools or link to third-party sites. We don’t control and aren’t responsible for those tools or sites. Your use of them is at your own risk and subject to the third party’s terms and policies.

10) Acceptable use

Don’t misuse the Services. Prohibited uses include: illegal activity; IP infringement; harassment or discrimination; submitting viruses or malicious code; scraping or unauthorized data collection; and interfering with security or network features. We may suspend or terminate access for violations.

11) Privacy & communications

Your use of the Services is subject to our Privacy Policy. We’ll send transactional emails about your orders. Marketing email/SMS is sent only with your consent; you can opt out anytime.

12) Errors, inaccuracies & outages

Occasionally the Site may contain errors or be unavailable. We may correct errors, change or update information, or cancel orders if information is inaccurate—at any time and without prior notice (including after you submit an order).

13) Warranties & disclaimers

Except as expressly stated by us in writing, the Services and all products are provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don’t guarantee uninterrupted or error-free operation.

14) Limitation of liability

To the fullest extent permitted by law, Twelveen and our directors, officers, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, revenue, savings, data, or goodwill, arising from or related to the Services or products.

In all cases, our total liability for any claim shall not exceed the amount you paid to Twelveen for the product(s) at issue in the 3 months before the claim.

Some jurisdictions don’t allow certain exclusions or limitations; in those places, we limit our liability to the maximum extent permitted by law.

15) Indemnification

You agree to defend, indemnify, and hold harmless Twelveen and our affiliates, officers, directors, employees, agents, and suppliers from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your User Content, or your violation of any law or third-party right.

16) Severability

If any provision of these Terms is unlawful or unenforceable, the rest remains in effect. The unenforceable portion will be enforced to the maximum extent permitted by law.

17) Termination

These Terms remain in effect until terminated by you or us. You may stop using the Services at any time. We may suspend or terminate access at any time (e.g., if we believe you’ve violated these Terms). Obligations and liabilities incurred before termination survive termination.

18) Governing law & venue

Governing Law; Venue. These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. The exclusive venue for any dispute arising out of or relating to the Services shall be the state or federal courts located in New Castle County, Delaware, and each party consents to personal jurisdiction in those courts. Mandatory consumer protections under your local law remain unaffected where required.

19) Changes to the Services or Terms

We may change, suspend, or discontinue any part of the Services at any time. We may update these Terms by posting a new version on this page. Please check back periodically. Your continued use of the Services after changes are posted means you accept the updated Terms.
